Montbell Club Global Membership Agreement

Article 1: Montbell Club Global Membership Registration

Membership registration for Montbell Club global membership may be processed and completed by individuals who wish to utilize Montbell Club global member services (hereinafter referred to as the "Service") by providing certain specified information such as their name, address, telephone number, email address, etc. Thereafter, upon Montbell Co., Ltd. (hereinafter referred to as the "Company") issuing a member number, the relevant individual will obtain Montbell Club global membership. The applicable membership eligibility requirements and the information about the membership card are as follows.

Please note that individuals wishing to register as Montbell Club global members who fall under any of the items of Article 10.2, have lost their membership eligibility, or are deemed inappropriate as such members by the Company, may have their membership registration refused.

1. Membership Eligibility

You must be a resident of a country other than Japan. Residents of Japan are unable to register as global members (each, a "Member"). If you register for a Montbell Club global membership and subsequently change your address to Japan, your status as a Member will become "Invalid" and your points will be invalidated.

2. Membership Card

Your membership card will be sent together with the products you purchased at the time of enrollment as a Member. If your address is unregistered, or if your registered address is different from the address where the ordered products are being sent, you will not receive your membership card. There may be cases where the membership card does not arrive if you have canceled part of your relevant order.
If you enroll as a Member at a Montbell Store, you may have your membership card issued at the applicable store.
The membership card and its benefits can only be used by the registered Member. If your membership card is transferred or lent to another person, or if any other fraudulent activity is made, it will be invalidated.
Your membership card should be managed at your own responsibility, as the registered Member. In the case of any loss, damage, theft, or any other issues, you are requested to promptly contact the Montbell Club.

Article 2: Management of Login ID and Password

As a Member, you are responsible for appropriately managing your login ID and password (hereinafter referred to as the "Montbell Account Information") for the Service provided. You must not allow any third party to use this information, or lend, transfer, disclose, or leak this information to any third party.
Use of the Service by using your Montbell Account Information shall be deemed actions taken by you, as the user responsible for managing such Montbell Account Information. You shall bear responsibility for any damages resulting from inadequate management of your Montbell Account Information, errors in its use, or third party use.The Company is not liable for any such damages, except in cases of its intentional act or negligence leading to default of its obligations or tortious acts by the Company.

Article 3: Handling of Personal Information

The Company handles information regarding the Members in accordance with the "Privacy Policy" separately set forth by the Company.
Even if withdraw your membership, lose your global membership status, or cease to be a Member for any other reason, the Company will retain your personal information for a fixed period of time for purposes such as responding to inquiries.

Article 4: Disclaimer

When the Service is used following the predetermined means of identity verification (such as verification against registered information, procedures through your My Page, or presentation of your membership card), it is considered to be used by you, as a Member. The Company does not assume any responsibility or liability for damages incurred by Members due to unauthorized use or use by third parties other than the applicable Member, unless it is due to the Company's intentional act or negligence or tortious acts by the Company.
In cases where the Company is liable due to its intentional act or negligence (excluding gross negligence) leading to default of its obligations or tortious acts, the Company shall provide compensation only for the direct and ordinary damages actually incurred by Members.

Article 5: Montbell Points

1. Accumulation of Points

Points are accrued based on the payment amount. Please check the Montbell website for the point accumulation rate.
At Montbell Stores, please present your membership card before payment. Points cannot be accrued if your membership card is not presented.
On the Montbell website, please use the Service after entering your Montbell Account Information and logging in as a Member. Points cannot be accrued if you are not logged in.
When a purchased product is returned, the amount of points accrued at the time of purchase will be deducted from your current point balance. If the return of a purchased product results in a negative point balance, the negative balance will be offset against the refund amount, or points accrued on future purchases will be reduced as compensation until the negative balance is cleared.
Points will only be credited to the account of the registered Member. Points cannot be retroactively accrued on past purchases.

2. Use of Points

Points can be used in three different currencies, depending on the Montbell Store or website that you are using. Japan: 1 point = 1 yen, United States: 1 point = $0.01, Switzerland: 1 point = 0.01 Swiss francs.
When using points at a Montbell Store, please present your membership card before payment. Points cannot be used if the card is not presented.
When using points on the Montbell website, please enter your Montbell Account Information and use the Service while logged in as a Member. Points cannot be used if you are not logged in.
Montbell points cannot be exchanged for legal tender.
If you return any products purchased using your points, the refund will be made for the payment amount excluding the points used from the purchase price.

3. Expiration Date of Points

Your Montbell Club points expire 24 months after the date of your last purchase as a member.

4. Additional Information about Points

Points are non-transferable. In addition, points earned on two or more different accounts cannot be combined.
You can check your points balance on your My Page.

Article 6: Change of Registered Information

If there are any changes to your registered information such as name or address, please update them on your My Page.

Article 7: Loss, Damage, or Theft of Card

You can stop using your points by contacting the Montbell Club. Membership cards cannot be reissued.

Article 8: Membership Benefits

Membership benefits may be subject to change or discontinuation without prior notice.

Article 9: Prohibited Acts

As a Member, you must not engage in any of the following acts:

Purchasing goods for the purpose of resale or other profit-making activities;
Acts that obstruct or may obstruct the operations of Montbell Stores or the Montbell website;
Acts that cause annoyance, disadvantage, or damage to the Company or third parties;
Acts that infringe upon the Company's or third parties' intellectual property rights, other property rights, portrait rights, privacy, honor, or other rights and interests;
Criminal acts, acts contrary to laws or public order and morals;
Acts of support or cooperation with anti-social forces;
Acts that directly or indirectly promote the acts listed above; and
Any other acts deemed inappropriate by the Company, in accordance with the preceding items.

Article 10: Withdrawal Procedures and Loss of Membership Qualification

1. Withdrawal Procedures

If you wish to withdraw from your Montbell Club global membership, you can do so through the My Page on the Montbell website.
After withdrawal, your membership card, Montbell Points, and all other membership benefits will be terminated.
Withdrawal is not possible if there are pending orders yet to be shipped or settled. Please complete the withdrawal process after your ordered products have been shipped or settled.

2. Your membership qualification shall be lost in the following cases:

where you engage in any acts in violation of Article 9;
where you violated any of the terms and conditions of this Membership Agreement; or
other cases where the Company determines that you are inappropriate as a Member.

Article 11: Amendment of Membership Agreement

This Membership Agreement is subject to amendment as necessary, to the extent that it is in the general interests of Members, or to the extent that it is reasonable and not inconsistent with the purpose of this Membership Agreement. In the event of amendment of this Membership Agreement, the Company will notify Members of the contents of the amendment, and the effective date of the amendment, by posting at an appropriate location on the Montbell website or by other means deemed appropriate by the Company. The amended Membership Agreement shall come into effect from the specified effective date.

Article 12: Language

This Membership Agreement is provided and written in Japanese. A translation of this Membership Agreement is provided for reference purposes only and shall not affect the interpretation of this Membership Agreement.

Article 13: Governing Law

This Membership Agreement shall be governed by and construed in accordance with the laws of Japan.

Article 14: Arbitration

All disputes, controversies or differences which may arise between the parties hereto, out of or in relation to or in connection with this Membership Agreement shall be finally settled by arbitration in Tokyo, Japan, in accordance with the Commercial Arbitration Rules of the Japan Commercial Arbitration Association. The number of arbitrators shall be one (1). The award rendered by the arbitrator shall be final and binding upon both parties.
